With the adoption of NIL (name, image, and likeness) in the NCAA, student athletes are becoming a target for lawsuits. This NIL policy means that athletes can earn compensation based on their likeness. Essentially, student athletes can become more even celebrity-like and can now get paid a lot of money for it. Celebrities and other high-net-worth individuals are more likely to end up in a lawsuit, and thus they carry specialty liability insurance to protect their assets. XINSURANCE provides student athlete liability insurance to help protect these young adults from financial or reputational loss.

With XINSURANCE, you can have an all-in-one policy that provides customized coverages built into one policy! We can offer liability protection for emerging risks and fill the gaps to cover exclusions in your existing insurance policy. Whatever you need, we can help to find the best insurance solution for you!

What is NIL?

NIL stands for name, image, and likeness. It is a new policy that the NCAA adopted and allows athletes to earn compensation for their likeness.

Quoted from the NCAA, the policy provides the following guidance to college athletes, recruits, their families and member schools:

  • Individuals can engage in NIL activities that are consistent with the law of the state where the school is located. Colleges and universities may be a resource for state law questions.
  • College athletes who attend a school in a state without an NIL law can engage in this type of activity without violating NCAA rules related to name, image, and likeness.
  • Individuals can use a professional services provider for NIL activities.
  • Student athletes should report NIL activities consistent with state law or school and conference requirements to their school.

At the high school level, not every state has adopted this NIL policy. According to Opendorse, the states that have approved NIL activities include Alaska, California, Colorado, Connecticut, Idaho, Iowa, Kansas, Louisiana, Maine, Massachusetts, Minnesota, Nebraska, New Jersey, New York, North Dakota, and Utah.

Scenarios That May Be Covered Under Student Athlete Liability Insurance

All the coverages should be designed for 3rd parties, with the exception of the coverage for hazing.

  • Self-defense insurance
  • Social media issues and school authority to sanction student athletes – We want to be able to defend student athletes who are faced with sanctions over social media postings that the school deems inappropriate or against the athletic code of conduct.
  • Alleged sexual harassment, sexual abuse, or molestation
  • Retaliation against complainants – If a student/coach/parent voices concern over an alleged Title IX issue, this would protect the person from retaliation for bringing that concern to the attention of the school. An example would be if an athlete was kicked off the team after voicing a concern.
  • Title IX and gender equity – Title IX of the Education Amendments Act of 1972 is a federal law that states: “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.” Sexual harassment is covered under Title IX, as is sex-based discrimination in STEM courses. Another example is discrimination based on pregnancy.
  • Transgender policies – Inclusion of transgender athletes in school sports, including that student’s right to privacy, safety, and dignity. This would also be a violation of Title IX if a transgender student were not allowed to participate in a sport.
  • Pregnancy – An example would be that student athletes can’t be penalized because of pregnancy, termination of pregnancy, childbirth, or related conditions. These students must be afforded the same treatment as any other student with a temporary disability.
  • Hazing – To help if the person is being hazed.
  • Constitutional rights of student athletes – A student athlete suspended for inappropriate criticism of a coach, or a suspension for attendance at a party where alcohol is served, suspension for failing a drug test, suspension for misbehavior, and a suspension alleged to be more severe than that given to other students for the same offense are some examples that can violate constitutional rights.
  • Liability for sports injuries
  • Concussion management & return to play protocols – All 50 states and the District of Columbia now have a sports concussion law in place. Most of the state laws contain three common tenets: 1) any athlete suspected of having sustained a concussion must immediately be removed from play; 2) the athlete may not be returned to action the same day; and 3) the athlete may be returned to action only after written clearance is provided by a licensed health-care professional (the definition of which varies widely from state-to-state).
  • Income Interruption
